MI shooter’s parents sh…ty but probably not guilty

The parents of the Oakland school shooter are probably not guilty unless it can be shown that they knew their son was going to shoot the students.  Their actions do not seem to fit the three elements required for involuntary manslaughter in Michigan.

It doesn’t mean that they might not be shitty parents, but as a society we should make sure we use the law as it is written and intended not as some would like it to be.

Michigan - 3 required elements of [involuntary ] manslaughter:

1. That the defendant caused the death of the deceased victim, that the deceased individual died as a result of the defendant's action. WEAK

2. That the defendant either:
a. intended to [unintentionally] kill[ed] the victim NOPE
b. intended to do [unintentionally did ] great bodily harm to the victim,NOPE
or
c. created a situation where the risk of great bodily harm or death was very high MAYBE, knowing that as a result of the defendant's actions he or she knew UNLIKELY that serious harm or death would likely result.

3. That the defendant caused the death of the victim WEAK without justification or lawful excuse.

Kim Potter Should be found innocent

Tragedy? Yes.      Manslaughter? No

Daunte Wright was stopped for having an expired license plate and something hanging from his mirror.   During the stop the officers found out that he had an outstanding warrant.  He then resisted arrest and tried to flee.

Officer Potter then shoots him, apparently by accident, thinking she was using her tazer.

The political district attorney Ellison is overcharging her with first and second-degree manslaughter. However, if you look at the elements of second-degree manslaughter in Minnesota(see below), it does not appear that she should be found guilty because there appears to be a key missing element of second-degree manslaughter: consciously taking chances that will kill or severely harm somebody

Three elements required for 2nd degree Manslaughter in MN

1. Causes the Death-yes

2. Culpably Negligent-maybe

3. Consciously - nope

Wright had at least two previous charges against him and at least one outstanding warrant.

Case number 27-CR-19-29850 refers to a 2019 aggravated robbery charge against Wright. The register of actions indicates the notice of hearing for this case was sent to the wrong address, but the court did not respond with a warrant

Case number 27-CR-21-4400 refers to a charge against Wright for possession of a pistol without a permit and fleeing a police officer. The court issued a warrant for Wright’s arrest for failing to appear at the hearing. That warrant was active at the time of Wright’s death.

609.205 MANSLAUGHTER IN THE SECOND DEGREE.

A person who causes the death of another [YES] by any of the following means is guilty of manslaughter in the second degree and may be sentenced to imprisonment for not more than ten years or to payment of a fine of not more than $20,000, or both:

(1) by the person's culpable negligence [MAYBE] whereby the person creates an unreasonable risk, and consciously [NOPE] takes chances of causing death or great bodily harm to another; or

(2) by shooting another with a firearm or other dangerous weapon as a result of negligently believing the other to be a deer or other animal; or

(3) by setting a spring gun, pit fall, deadfall, snare, or other like dangerous weapon or device; or

(4) by negligently or intentionally permitting any animal, known by the person to have vicious propensities or to have caused great or substantial bodily harm in the past, to run uncontrolled off the owner's premises, or negligently failing to keep it properly confined; or

(5) by committing or attempting to commit a violation of section 609.378 (neglect or endangerment of a child), and murder in the first, second, or third degree is not committed thereby.

If proven by a preponderance of the evidence, it shall be an affirmative defense to criminal liability under clause (4) that the victim provoked the animal to cause the victim's death.

Biden's meaningless jobs claim

The Biden Administration claims they have created a record number of jobs of any president in their first 10 months.  While this may be a factual number, it is a MEANINGLESS claim.

Biden has an economy that is still recovering from a pandemic shutdown. To take credit for a record number of jobs created in the first 10 months of an administration is meaningless as shown in the chart below where you can see that after the pandemic shut-down Trump created 13 million jobs while Biden has only created 5 million jobs.

What is important is the percent of the population that is working.  As you can see, Biden is still woefully short of where the economy was before the pandemic shutdown and it is likely that his increased subsidization of people not to work and his various vaccine mandates are negatively affecting the labor force participation.

Systemic Racism?

In addition to the horrible black on black crimes leading to outrageous numbers of young black deaths there is also a problem that nobody seems to talk about: the disproportionate black on white crime.

Society needs to do something about both of these but if the Democrats continue to propagate the false narrative that systemic racism is all the problem we
will never identify the real issues.

(Dec 2021) Davide Giri, 30-year-old PhD student in computer science at Columbia university stabbed to death allegedly by Vincent Pinkney, 25, of Washington Heights said to be a gang member based in Queens who was out on parole after serving four years behind bars for gang assault and having 16 prior arrests.

(Dec 2019) Tessa Majors, first-semester freshman at Barnard in NYC studying stabbed to death by two 14 year olds, Luchiano Lewis and Rashaun Weaver and a 13 year old.

(Nov 2021) Shaoxiong “Dennis” Zheng, a recent graduate of the University of Chicago master’s program in statistics shot and killed in Chicago allegedly during a robbery by Alton Spann, 18,  on parole for a 2019 armed robbery and vehicular hijacking conviction when he was a juvenile and had an extensive juvenile court history.

How is this fair to women?

Lia Thomas, a 22-year old transgender swimmer at the University of Pennsylvania, has been shattering women’s records at the school.

Before her transition, she competed for three years at Penn as a man, named Will Thomas.

If you have a functioning SRY gene you will develop testes and will not have ovaries and will not be capable of becoming pregnant. Then, if you have normal biological functioning, you will have significantly higher levels testosterone and, on average, be bigger, faster, and  stronger than someone without a functioning SRY.  Almost without exception, this means people born with the SRY are functioning males that have levels of testosterone that allow them to be bigger, stronger and faster, on average, than females.

It is unfair in almost all cases for someone with the SRY gene (male) to compete with someone without it(female.)

Did Pfizer and the FDA kill 50,000 and sway the election?

In October 2020 Pfizer stopped analyzing nasal swabs from patients with suspected COVID in their vaccine trial. If they had analyzed these swabs and reached a cumulative total of 32 infections they would have been required to notify the FDA and the security exchange commission and had to disclose vaccine was very effective.  On November 3 they began analyzing the nasal swabs and found they had 94 cumulative cases and on November 8 they publicly announced the positive results from the vaccine trial.

For some reason Pfizer, after talking with the FDA, decided to try to change the trial design for the first efficacy evaluation from 32 cases to 62 cases. However, until this change was approved by the FDA, Pfizer would have been required to evaluate efficacy at 32 cases. Pfizer would have known that they would reach the 32 cases well before the election and have been required to publicly disclose the efficacy of the vaccine and they would have known that stopping the analysis of nasal swabs would prevent them from getting to 32 cases.

What happened? The study change from initial efficacy evaluation from 32 to 62 cases was approved November 3. By November 8 they publicly disclosed that they had 93 cases, well above the 32 threshold and even above the 62 threshold.

Of course they claim there was no political motivation for this and they had no discussions with the FDA about this. Given they are saying it will  take them 26 years to produce the documents related to their vaccine approval required by FOI requests, one has to wonder.

It is estimated that the delay in vaccine approval caused by their intentional delay of analyzing nasal swabs was about two months and may have resulted in 50,000 additional deaths.

Dem’s think blacks are less capable

Josh Thompson, an English teacher at Blacksburg High School in Virginia: “Making sure that you’re following directions, and making sure that you’re sitting quietly, and you are in your seat, all these things that come from white culture. So if we’re positively enforcing these behaviors, we are by extension positively enforcing elements of white culture, that keeps whiteness at the center — which is the definition of white supremacy,” *1

Over 92% are essentially vaccinated

The NIH has tested blood samples for COVID antibodies from  1 443 519 blood donations from July 2020 through May 2021 from a area representing 74% of the US population.

When the results are adjusted to fit the actual demographics of United States they estimate that as of May 2021, 83% of the US population have either been vaccinated and/or had COVID.

With the fact that the antibody tests give false negatives for some infections and more recent blood samples included it is estimated that over 92% of the population has antibodies.

While this doesn’t mean that people will not be reinfected by new variants of the virus overtime, it is highly likely that re-infections will have much much lower morbidity and mortality and that this will become more more like a flu or even hopefully a cold a virus

Brandon’s (Biden’s) Afghan F’ups Cont’d

The Taliban are carrying out retaliatory killings in spite of their assurances to the contrary.

State Department Special Representative and Deputy Assistant Secretary for Afghanistan Thomas West took to Twitter to declare that the U.S. is “deeply concerned” and to urge the Taliban to “ensure their promise of amnesty is upheld.

Facebook Censors Truth

Lomborg was censored for pointing out “rising temperatures have actually saved lives.” That’s because cold weather kills more people than warm weather.

They censored me for saying we’re not in a sixth mass extinction,” Shellenberger complains. “We’re not!

“They’re trying to suppress people whose opinions and whose evidence they don’t like,” concludes Tierney. “They’re not fact-checkers, they’re fact-blockers.”

the social-media giant banned a well-reasoned Post opinion column by China scholar Steven Mosher that speculated about a potential lab leak.

Facebook determined that the only speech allowed on its platform was to declare Rittenhouse’s guilt, not his innocence.

Right before the election, Facebook completely censored the New York Post’s story published on its cover that it heralded as a “blockbuster” scoop: “smoking gun” evidence, in its words, in the form of emails purportedly showing that Joe Biden’s son, Hunter, traded on his father’s position by securing favors from the then-vice president to benefit the Ukranian energy company Burisma, which paid the supremely unqualified Hunter $50,000 each month to sit on its Board

Why don’t these lives matter?

Where’s the outrage? Where’s BLM? Where’s Lebron?

Another week and more lives lost. Until the Democrats stop propagating the false narrative nothing will change.

Black lives matter - I support the words but cannot support the organization because it propagates the false narrative that systemic racism is the primary cause of the disparities(incarceration, teen mothers, fatherless households, income, wealth, etc.) between blacks and whites.

Racism exists, it’s bad, and we should continue to work to reduce it. Excess police force is bad and we should continue to work to reduce it.

BLM organization’s positions and policies do not address the problems (murders, fatherless households, teen pregnancy) and do not address the key root causes (it’s not excessive police force or systemic racism.) https://moxlosllc.blogspot.com/2021/11/wheres-biden-blm-and-lebron-11921.html

Biden/Dems Trash Constitution

Biden, Democrats and Main Stream Media are attacking the fundamental rights that are a foundation of our nation: presumption of innocence, due process, trial by jury, proof of guilt beyond a reasonable doubt.

Biden-“angry and concerned” about verdict
Jerry Nadler (D Chair House Judiciary Committee): verdict ”justifies federal review by DOJ”
Cori Bush (D MS): “white supremacy in action”
AOC: “ system functioning as designed and protecting those it was designed for [White supremacists]
MSNBC: verdict is an outrage and a brazen miscarriage of justice
Kamala Harris: “there’s still a lot more work to do” [To make our system equitable]

Biden’s anger?

Joe Biden is angry about the Rittenhouse jury verdict. I wonder how much that anger justifies others’ anger. I hope that wasn’t the justification for the man who killed innocent children. But I know propagating false narratives is tearing our country apart.
